Former head of the Prison no. 5 of Cahul, Alexander Malina, sentenced to six years in prison for torture and accused by Anticorruption prosecutors of extorting bribes, remains free. Court of Appeal postponed for the third time the examining of the case on the grounds that one of Malina's accomplices was not present at the proces. The victim of the former official, Simon Jereghi, who is serving a sentence for another offense, claims that his torturers, helped by lawyers, deliberately delayed the examination.
Alexander Malina was sentenced by the Military Court on 10 September 2015. Along him were convicted five of his subordinates to five years in prison and forced to pay fines of MDL 16 to 20 thousand. None of the six were handcuffed.
According to the sentence, Malina and his subordinates during the years 2010-2012 mocked many detainees in their custody, including minors, who he beat mercilessly. One of the victims was forced to repeat his name several times, and when he refused, he was taken in a separate cell and brutally beaten. One of the tortured detainees committed suicide in his cell.
Alexander Malina was defended by lawyer Andrei Dunas. On 10 May 2016, Dunas and Malina were detained by NAC officers, being suspected of extortion of EUR 16.000 and USD 13.300 from a family of a sentenced to 18 years in prison. According to a press release from the NAC, during 2014 - 2016, the suspects allegedly asked money from the prisoner's mother under the pretext that they can influence more judges and officials of the Penitentiary Department to release her son prematurely. According to the informer, the two said that they can get from the Special Medical Commission of DIP a medical certificate attesting a serious illness of which he would suffer and the convicted man would be released ahead of schedule.
